1. Acceptance of Terms

By downloading, installing, or using the calndr mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and calndr ("we," "our," or "us"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including without limitation users who are browsers, customers, merchants, vendors, and/or contributors of content.

2. Description of Service

calndr is a co-parenting calendar application designed to help families coordinate schedules, manage custody arrangements, and facilitate communication between co-parents. The App provides features including but not limited to:

• Shared calendar functionality for family scheduling
• Custody schedule management and tracking
• Event creation and notification systems
• Family communication tools
• Photo and document sharing capabilities
• Expense tracking and management

3. Eligibility and Account Requirements

Age Requirements

• You must be at least 18 years old to create an account
• Users between 13-17 may use the App with parental consent and supervision
• Children under 13 may only access the App through a parent's account

Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information when creating your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

• Violating any applicable laws or regulations
• Harassment, bullying, or intimidation of other users
• Sharing inappropriate, offensive, or harmful content
• Attempting to access another user's account without permission
• Interfering with or disrupting the App's functionality
• Using the App for commercial purposes without our consent
• Reverse engineering, decompiling, or attempting to extract source code
• Creating multiple accounts to circumvent restrictions
• Sharing false or misleading information
• Using the App in any way that could harm children or families

5. Intellectual Property Rights

Our Rights

The App and its original content, features, and functionality are and will remain the exclusive property of calndr and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

Your Content

You retain ownership of content you submit to the App. However, by using the App, you grant us a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing and improving our services.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.

6. Subscription and Payment Terms

Subscription Plans

calndr offers both free and premium subscription plans. Premium features may include advanced scheduling tools, enhanced storage, and priority support.

Apple App Store Purchases

• All purchases are processed through the Apple App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions in your App Store account settings
• Refunds are handled according to Apple's refund policy
• Prices may vary by region and are set by Apple

Free Trial

If we offer a free trial, you may cancel at any time during the trial period to avoid charges. If you don't cancel, you'll be charged for the subscription.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.

8. Disclaimers and Limitation of Liability

Service Availability

We strive to keep the App available, but we cannot guarantee 100% uptime. The App is provided "as is" without warranties of any kind, either express or implied.

Limitation of Liability

User Responsibility

You acknowledge that the App is a tool to assist with co-parenting coordination and does not replace legal advice or court orders. You are responsible for complying with all applicable laws and court orders.

9. Termination

Termination by You

You may terminate your account at any time by deleting the App and discontinuing use. You can also request account deletion through the App settings or by contacting support.

Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App ceases immediately.

Effect of Termination

• You will lose access to your account and data
• We may delete your data in accordance with our Privacy Policy
• Certain provisions of these Terms will survive termination

10. Apple App Store Terms

These Terms are between you and calndr only, not Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.

Apple's Rights and Responsibilities

• Apple may remove the App from the App Store at any time
• In case of App failure, Apple's maximum liability is limited to the purchase price
• Apple is not responsible for addressing any claims relating to the App
• You acknowledge that Apple is a third-party beneficiary of these Terms

Export Control

You represent that you are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government prohibited or restricted party list.

11. Governing Law and Disputes

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration.

Dispute Resolution

• Most disputes can be resolved through our customer support
• If informal resolution fails, disputes will be resolved through individual arbitration
• You waive the right to participate in class action lawsuits
• Either party may seek injunctive relief in court for intellectual property violations

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you through the App or by email
• For material changes, provide at least 30 days' notice
• Give you the opportunity to review changes before they take effect

Your continued use of the App after changes take effect constitutes acceptance of the new Terms.

13. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and calndr regarding your use of the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

• You may receive transactional and promotional SMS messages related to your account and the calndr service. Message frequency may vary.

• Opt-out: Reply STOP to cancel at any time. You will receive a confirmation message.
• Help: Reply HELP for assistance or contact support@calndr.club.
• Carriers are not liable for delayed or undelivered messages.
• Supported carriers may vary by region and are subject to change without notice.
